The “chocolics.com” website provides its services to its customer “you” subject to the notices, terms and conditions that herein may be modified from time to time in the agreement “Agreement” under which you may use and access the website. The terms and conditions apply to all members and visitors who access https://chocolics.com/ 

Use of Site

Chocolics grants you a limited license to access and make personal use of the Site and services. You are not allowed to reproduce, modify, distribute, display any portion, distribute, publish any content or make any commercial use of any of the information provided in this site.

You shall not distribute in any form, any information, or other material that violates, infringes the copyrights, patents, trademarks, trade secrets, logo or other proprietary rights of any person.

You are not allowed to republish, archive or retain any content on the internet, intranet, extranet, database, archive or compilation. You are not allowed to use any content for commercial use.

You agree not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the Site, and not to insert any code or product or manipulate the content in any way that affects the user’s experience.

You are not allowed to use the Site in any manner that is illegal or impairs the operation of the Site or its availability or usage by others.

You further agree not to use any data mining, bugs, viruses, worms, trap doors, web crawlers, robots, cancelbots, spiders, Trojan horses, other harmful code of properties or any data gathering or extraction method in connection with your use of the Site.

You are not allowed to make any use of the Site for the benefit of another business.

Trademark

All text, graphics, button icons, logos, trademarks, audio clips, video, clips, slogan, banners, software belongs exclusively to Chocolics. All software used on this Site is the property of Chocolics. You are not allowed to use Chocolics trademarks in any manner that disparages, discredits or in any way.

Modifications

Chocolics reserves the right to make changes to the site, related policies and amendments in the Agreement at any time. Therefore you are requested to check the Terms of Services page frequently to be aware of any changes.

Billing

The price of the products at Chocolics is inclusive of VAT. The vat charged shall depend upon the destination where the order has to be shipped. The tax rate applied to the order will be the combined tax rate for both state and local tax rates in accordance with the address where the order is being shipped. Chocolics reserves the right to collect taxes for shipping charges wherever applicable.

Cancellations

Cancellations by Chocolics

Chocolics has a right to cancel or refuse the order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account.

Cancellations by You

In case of requests for order cancellations, Chocolics reserves the right to accept or reject requests for order cancellations for any reason. For you to cancel an order there is a time period of 24 hours from the time you can cancel the order. As part of usual business practice, if we receive a cancellation notice and the order has not been processed / approved by us, we shall cancel the order and refund the entire amount.

We will not be able to cancel orders that have already been processed. Chocolics has the full right to decide whether an order has been processed or not. You agree not to dispute the decision made by Chocolics and accept Chocolics decision regarding the cancellation.

Frauds

Chocolics reserves the right to recover the cost of goods, collection charges and other expenses that may occur from persons for using the Site fraudulently. Chocolics reserves the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts or omissions in breach of these terms and conditions.

Shipping

We deliver the products to our customer within 7 business days of purchase.
However, in case of any unavoidable circumstances, the customers would be duly informed.

Credit Card Details

You must agree, understand and confirm that the credit card details provided by you for using services on Chocolics will be correct and accurate. You shall not use the credit card which is not lawfully owned by you. Further, you agree and confirm to provide the correct and valid credit card details to Chocolics.
Chocolics will not be liable for any credit card fraud. The liability for use of a card fraudulently will be your responsibility.

Indemnity

You agree to indemnify and hold Chocolics (and its officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys’ fees, or arising out of or related to your breach of this TOS, or your violation of any law or the rights of a third party.

Electronic Communication

When you use the Site and email to Chocolics, you are communicating with Chocolics\ electronically. Chocolics will communicate with you by email, notices or SMS on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

This Site may contain links to other sites on the Internet that are owned and operated by third parties. You acknowledge Chocolics is not responsible for the operation of or content located on or through any such site.

To the extent that this Site contains links to outside services and resources, the availability and content of which Chocolics does not control, and any concerns regarding any such service or resource, or any link thereto, should be directed to the particular outside service or resource. In addition, certain Third Party Sites also may provide links to the Chocolics website. None of such links should be deemed to imply that Chocolics endorses the Third Party Sites or any content therein.

Access to any Third Party Sites is at your own risk and Chocolics will have no liability arising out of or related to any such websites and/or their content or for any damages or loss caused or alleged to be caused by or in connection with any purchases, use of or reliance on any such content, goods, or services available on or through any such Third Party Sites.

Termination

Chocolics has right to immediately terminate the Agreement between you and Chocolics. Upon any termination of this Agreement, you shall immediately cease all access to and use of this Site and immediately revoke all passwords and identification issued to you and deny your access to and use of this Site in whole or in part.

Product Information

Chocolics has made every effort to display as accurately as possible the colours of our products that appear on the Site. Further, Chocolics has ensured that the measurements, information and description for products furnished on the site are best calculated and stated to accuracy and true to its dimensions. However, due to the inherent characteristics of certain materials, actual measurements of individual items might vary slightly. Slight marks and colour / print variations should not be considered as a fault, but they are inherent characteristics of the product.

Typographical Errors

There may be information on this Site that contains typographical errors that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information without prior notice.

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, Chocolics shall have the right to refuse or cancel any orders placed for product listed at the incorrect price whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Chocolics shall immediately issue credit in the amount of the charge.

Governing Laws and Jurisdictions

This Agreement and the relationship between you and Chocolics will be governed by the laws as applicable in India. Any disputes will be handled in the competent courts of New Delhi, India. This Agreement constitutes the entire agreement between you and Chocolics and governs your use of the Site, superseding any prior agreements between you and Chocolics with respect to the Site.

Privacy Policy

Chocolics protects all the information you share with us. We follow strict steps to help protect the confidentiality, security, and integrity of data stored on our systems. Only those employees who need access to your information in order to perform their duties are allowed such access. Any employee who violates our privacy and/or security policies is subject to disciplinary action, including possible termination and civil and/or criminal prosecution.
